Terms and Conditions
1. Introduction
These Terms and Conditions govern the purchase and use of the services provided by Spanish Business Class, operated by Inmaculada Concepción López Puerto and established in Portugal.
By purchasing a service, the student confirms that they have read and accepted these Terms and Conditions.
The creation of a preliminary account or internal record for the purpose of booking a level assessment does not, by itself, constitute the purchase of a paid service.
2. Age Restriction
The services provided by Spanish Business Class are intended exclusively for adults aged 18 or over.
Students must be at least 18 years old to purchase a course, tutoring package or any other paid service.
Spanish Business Class does not accept contracts entered into by minors.
3. Services and Plans Offered
Spanish Business Class provides online Spanish-language education services for levels A1, A2, B1, B2, C1 and C2.
Depending on the student’s assigned level and the product or plan purchased, the service may include:
- access to digital learning materials;
- recorded videos;
- PDF documents;
- exercises;
- downloadable resources;
- level assessments;
- access to a private student area;
- live online tutoring sessions;
- educational monitoring and course-progress management.
Plans for A Levels
Students assigned to an A level may purchase one of the following plans:
- By Stage;
- Complete Program
These plans provide access to the digital learning content corresponding to the student’s assigned A1, A2 level, subject to the scope and conditions of the selected plan.
Access to the specific course remains subject to completion of the required level assessment and manual assignment of the appropriate level by the teacher.
Plans for B and C Levels
Students assigned to a B1, B2 or C1, C2 level may purchase one of the following plans:
- 5H Plan;
- 10H Plan;
- 20H Plan.
The services, content, tutoring support and other features included in each plan will be those displayed on the relevant product page.
The number of tutoring sessions or tutoring credits associated with a plan is not permanently fixed in these Terms and may vary according to the commercial configuration of the plan.
Any change to the tutoring allocation or content of a plan will apply to future purchases. It will not retroactively reduce the services already confirmed in an existing order, unless the student expressly agrees or the change is required or permitted by applicable law.
Some products may combine digital content, downloadable materials, educational support and live tutoring services.
The exact features, price and conditions of each product will be displayed before the purchase is completed.
4. Level Assessment and Course Assignment
Access to the definitive course depends on the completion of a level assessment.
The student may:
- complete the level assessment before purchasing a plan; or
- purchase a plan first and complete the level assessment afterwards.
Where a student purchases a plan before completing the assessment:
- the purchase will be registered;
- a student account may be created;
- the purchased plan will be associated with the account;
- access to the specific course will remain pending until the teacher assigns the appropriate level.
The level is assigned manually by the teacher according to the result of the assessment.
The plan purchased must correspond to the level assigned by the teacher.
Purchasing a plan does not allow the student to freely select or access courses assigned to other levels.
5. Student Account
A student account may be created automatically following a purchase or prepared as part of the level-assessment process.
The account is personal and may not be transferred or shared with another person.
The student is responsible for:
- providing accurate and up-to-date information;
- protecting their username, password and access credentials;
- notifying Spanish Business Class of any suspected unauthorised access;
- maintaining access to the email address associated with the account;
- using the platform and its materials in accordance with these Terms.
Spanish Business Class may temporarily suspend or restrict access where there is reasonable evidence of:
- account sharing;
- unauthorised distribution of course materials;
- fraudulent activity;
- unauthorised access;
- serious or repeated misuse of the platform.
Any suspension or restriction will be proportionate to the circumstances and will not limit any mandatory consumer rights.
6. Prices, Plan Features and Taxes
The applicable price and main features of each product or plan will be displayed before the purchase is completed.
The student will be able to review:
- the selected plan;
- the assigned or applicable level;
- the digital content included;
- the tutoring support included, where applicable;
- the total price;
- any applicable taxes or additional charges.
Prices, tutoring allocations and plan features may be updated for future purchases.
Changes will not retroactively reduce the services included in orders that have already been confirmed.
7. Payment Methods
Payments may be made through:
- Stripe ; or
- bank transfer.
Card payments are processed by Stripe. Spanish Business Class does not store complete credit or debit card details.
Where payment is made by bank transfer, the order and purchased service will not be activated until the payment has been received and successfully verified.
The student is responsible for providing the correct payment reference where one is requested.
8. Start of the Service
The contractual relationship begins when the order and the corresponding payment are confirmed.
The creation of an account does not necessarily mean that access to the definitive course has already been enabled.
Where the student has not completed the required level assessment, access to the specific course may remain pending until the teacher assigns the appropriate level.
For digital content, supply begins when access to the relevant course materials is effectively enabled for the student.
For tutoring services, performance begins when the first tutoring session or another tutoring service expressly requested by the student is provided.
9. Duration of Access to Digital Content
Digital materials purchased through Spanish Business Class do not initially have an ordinary expiration date.
Access will generally remain available provided that:
- the student account remains active;
- Spanish Business Class continues to offer the corresponding service;
- the website remains active;
- the learning platform remains operational.
This access must not be interpreted as a guarantee of permanent or lifetime availability.
Spanish Business Class may carry out:
- maintenance;
- technical updates;
- security changes;
- platform migrations;
- replacement of technical tools;
- reasonable modifications necessary to maintain or improve the service.
Where a technical or operational change substantially affects access to purchased content, Spanish Business Class will take reasonable measures to restore access or provide an appropriate alternative where reasonably possible.
10. Right of Withdrawal
Consumers generally have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to the conditions and exceptions established by applicable law.
Digital Content
Where a student purchases a product that includes digital content, they may be asked during checkout to expressly request that access begins before the end of the 14-day withdrawal period.
Where the student:
- expressly requests the early supply of the digital content;
- acknowledges the consequences for the right of withdrawal; and
- receives effective access to the digital content,
the right of withdrawal in relation to that digital content may cease once supply has begun, in accordance with applicable law.
Payment or account creation alone does not necessarily mean that the digital content has already been supplied.
Tutoring Services
For services that include tutoring, the right of withdrawal may apply during the statutory period where legally required.
Where the student expressly requests that tutoring begins before the end of the withdrawal period and later exercises the right of withdrawal, Spanish Business Class may charge the proportional amount corresponding to the services already provided, where permitted by law.
Exercising the Right of Withdrawal
Where the right of withdrawal applies, the student may communicate their decision through an unequivocal statement sent to:
The communication should include sufficient information to identify the student and the relevant order.
The student may use any legally valid withdrawal form, but the use of a particular form is not mandatory where an unequivocal written statement is sufficient under applicable law.
11. Refund Policy
Spanish Business Class does not ordinarily offer voluntary refunds once:
- the contracted service has begun;
- access to the relevant digital content has been effectively enabled;
- tutoring sessions have already been provided;
- the applicable withdrawal period has expired; or
- the right of withdrawal has ceased in accordance with applicable law.
This does not affect any mandatory right to a refund, correction, replacement, price reduction or other remedy.
A refund or other appropriate remedy may apply in cases including:
- duplicate charges;
- payment-processing errors;
- persistent inability to access the purchased service for reasons attributable to Spanish Business Class;
- defective or non-conforming digital content;
- permanent inability to provide outstanding tutoring services;
- substantial failure to provide the contracted service;
- any other situation in which a remedy is required by applicable consumer law.
Each request will be assessed according to the circumstances, the service already provided and the applicable legal requirements.
12. Tutoring Services
Depending on the plan purchased, the student may receive live tutoring sessions or tutoring credits.
The amount and conditions of the tutoring support included will be those displayed on the product page, checkout summary or order confirmation at the time of purchase.
Tutoring sessions may be delivered through:
- Microsoft Teams;
- Google Meet; or
- another online communication service agreed with the student.
The student is responsible for having:
- a compatible device;
- a stable internet connection;
- functioning audio equipment;
- any software or account reasonably necessary to join the session.
The student should join the session at the agreed time and promptly report any technical problem that prevents participation.
13. General Cancellation and Rescheduling Rule
Unless a different condition is expressly displayed for the purchased plan, students may cancel or reschedule a tutoring session without losing the corresponding credit by providing at least 24 hours’ notice before the scheduled start time.
Where a cancellation or rescheduling request is made less than 24 hours before the scheduled start time, the session may be considered used and deducted from the student’s available tutoring balance.
Where the student does not attend a booked session and has not provided the required notice, the session will be considered used and deducted.
Spanish Business Class may consider exceptional circumstances on an individual basis, but is not obliged to restore a tutoring credit where the required notice was not provided.
14. Specific Tutoring Conditions
Certain courses or plans may include specific conditions regarding:
- cancellation or rescheduling notice;
- the number of permitted changes;
- tutoring availability;
- booking frequency;
- session duration;
- expiry of tutoring credits.
Where specific conditions apply, they will be clearly displayed on the relevant product page, during the purchase process or in the order confirmation.
Specific conditions accepted as part of an order will prevail over the general tutoring rules in these Terms where they are more favourable or more directly applicable to the purchased plan.
Spanish Business Class may update the tutoring conditions offered with future plans. Such updates will not retroactively reduce tutoring services already confirmed in an existing order.
15. Cancellation by Spanish Business Class
Where Spanish Business Class needs to cancel or reschedule a tutoring session:
- the student will not lose the corresponding tutoring credit;
- the parties will attempt to arrange a replacement session;
- the tutoring balance will be restored where it had already been deducted.
Where a replacement session cannot reasonably be provided, the tutoring credit will remain available or another appropriate solution will be offered according to the circumstances.
16. Expiry of Tutoring Credits
Tutoring credits may be subject to an expiry period.
The applicable expiry period and its starting date will be those displayed on the relevant product page, during checkout or in the order confirmation.
Unless a different period is expressly stated for the purchased plan, unused tutoring credits will expire two years after payment for the corresponding order has been confirmed.
Each purchase may have its own expiry period.
A later purchase does not automatically extend the expiry date of tutoring credits obtained through an earlier purchase, unless Spanish Business Class expressly confirms otherwise.
Where Spanish Business Class becomes permanently unable to provide the outstanding tutoring service during the applicable period for a reason attributable to Spanish Business Class, the student will be entitled to an appropriate solution, which may include reimbursement of the proportional amount corresponding to the services that cannot be provided.
17. Intellectual Property and Permitted Use
Course materials are provided exclusively for the student’s personal educational use.
Students may download and retain those documents and resources whose download has been expressly enabled by Spanish Business Class.
Students may not:
- share account credentials;
- record live sessions without prior permission;
- copy or redistribute course videos;
- upload course materials to another website or platform;
- sell, sublicense or distribute PDF documents, exercises or lessons;
- make private course content publicly available;
- commercially exploit course materials;
- remove ownership, copyright or attribution notices.
The purchase of a course or plan does not transfer ownership of the course materials or intellectual-property rights to the student.
18. Transactional and Marketing Communications
Spanish Business Class may send communications necessary to manage:
- student accounts;
- orders and payments;
- level assessments;
- course assignments;
- access to digital content;
- bookings;
- cancellations and rescheduling;
- reminders;
- tutoring services;
- technical or service-related incidents.
These communications form part of the requested or contracted service and are not marketing communications.
Marketing communications will only be sent where the recipient has provided the required prior consent.
Every marketing communication will include a clear and free method to unsubscribe.
19. Applicable Law
These Terms and the services provided by Spanish Business Class are governed by the applicable laws of Portugal and the European Union.
This does not affect any mandatory consumer-protection rights that may apply according to the consumer’s country of habitual residence.
Nothing in these Terms excludes or limits any consumer right or business responsibility that cannot legally be excluded or limited.

20. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue to apply.
21. Changes to These Terms
Spanish Business Class may update these Terms to reflect legal, technical, commercial or operational changes.
The version applicable to a purchase will be the version made available to the student when the order was confirmed.
Changes will not retroactively reduce mandatory rights or alter services already purchased unless this is legally permitted and the student is appropriately informed.
